$500 K settlement highlights severity of victim’s injuries.
Motorcycle accident attorney Gary Cowan again proved that, when it comes to protecting the injured motorcyclists’ rights, MotorEagles won’t settle for anything less than what’s fair for its clients.
Cowan in April negotiated a $500,000 out-of-court settlement for his client: A 51-year-old Meadville, Penn. man who was severely injured when a negligent driver pulled into the path of the 2005 Harley-Davidson he was driving in Warren, Ohio May 6, 2007.
The client, then 49, was taken from the scene to a Youngstown, Ohio trauma center and was treated for an open, right comminuted femur (the thigh bone, which extends from the hip joint down to the knee joint) fracture and a fractured left humerus (the bone that extends from the shoulder to the elbow), among other injuries. He was hospitalized for five days following the wreck, undergoing two operations.
“He then followed up with an orthopedic surgeon who told him the femur did not heal well,” Cowan said. “There was a non-union, so they had to go back in, in February of 2008, and remove the hardware they had implanted and had to re-do the surgery to repair the femur by implanting a rod.”
He added the client underwent extensive physical and occupational therapy – about 11 months’ worth.
Cowan said the reason for State Farm’s eagerness to settle out of court was likely because the company understands that MotorEagles lawyers WILL take any case all the way to a jury, if necessary, and the demands in this particular case were reasonable – even to an insurance company.
“The fact is, with the types of injuries involved in this case, it was settled,” Cowan said. “To avoid the filing of a lawsuit, State Farm settled the case.”
He said he was happy with the outcome; not only because he’s satisfied he did a good job, but that it just proves further that the insurance companies know that MotorEagles attorneys are always ready and able to see a case through to trial, if need be.
“Insurance carriers are keenly aware of which trial lawyers will go the distance and fight for the rights of their clients,” Cowan said. “The only way we’re going to get insurance companies to try and settle their cases for a fair value is that they’ve got to know an attorney is going to take it all the way to a jury trial.”
